Commentary by Attorney Michael Grossman

There’s a particular detail here that makes me wonder if authorities ever gave this crash the attention it deserves. Generally speaking, it can be a red flag whenever multiple vehicles collide in an accident, yet only one person is injured—seriously, in fact. In my experience, this should be a clue to any investigator worth their salt to look into a potential vehicle defect.

Things like airbags, seatbelts, chair assemblies, and vehicle structure can all contribute to the safety of a vehicle occupant during a crash. If any of them fail or under-perform, injuries which could have been prevented may instead be serious. That’s why a serious crash should always be followed by a careful inspection of the vehicles involved.

Obviously, those inspections will often just rule out defects. There are certainly other reasonable explanations for why one person may have fared worse than others in a crash. It can be helpful, though, just to know if authorities are doing their own inspections. In my experience, when they overlook potential vehicle defects, it can be a sign they’re overlooking all kinds of other important possibilities.
