Commentary by Attorney Michael Grossman

When I see a report like this, my first thought is that I hope the injured driver gets the answers she needs about what caused this crash. A vehicle striking a concrete barrier may seem straightforward, but in my experience, crashes like this often require a deeper investigation. To truly understand what happened, three critical questions must be asked.

First, did the authorities thoroughly investigate the crash? A proper investigation should consider all possible factors, such as road conditions, lighting, traffic patterns and whether the driver attempted to brake or steer away before impact. Were there any roadway hazards or obstructions that could have contributed to the crash? Did authorities analyze skid marks or vehicle damage to determine if speed or another external factor played a role? Without a detailed investigation, crucial details could be overlooked.

Second, has anyone looked into the possibility that a vehicle defect caused the crash? The Ford F-150 involved in this crash is nearly 20 years old, and mechanical failures — such as brake malfunctions, steering issues or tire blowouts — could have played a role. If the truck unexpectedly lost control due to a defect, that would significantly change the understanding of the crash. Unfortunately, vehicle defects are rarely considered unless someone takes the step of preserving the vehicle and having it examined by an expert. If the truck is repaired or scrapped before an inspection, critical evidence could be lost.

Third, has all the electronic data relating to the crash been collected? The truck’s engine control module (ECM) may have recorded important data, such as speed, braking activity and steering inputs leading up to the crash. Additionally, nearby traffic cameras, surveillance footage from local businesses or dashcam recordings could provide valuable insight. Without this data, investigators may be left with only a partial understanding of what happened.

At the end of the day, crashes like this leave those involved with important questions. The least the community can do is ensure that every effort is made to uncover the full truth.
