Corpus Christi, TX — February 8, 2026, Elijah Gutierrez was killed as the result of an alleged intoxicated driver accident along Nile Drive.
Investigators said that the incident took place late Sunday in the area of Nile Drive and Ennis Joslin Road.
According to officials, 20-year-old Elijah Gutierrez was on a motorcycle at the time. Another driver reportedly failed to yield, crashing with Elijah Gutierrez. Due to the collision, Elijah Gutierrez was fatally injured.
The other driver is accused of being intoxicated at the time of the accident. Authorities reported charging that driver for intoxication manslaughter.

If these awful details are true, then authorities are clearly working toward some sort of accountability for this young man’s death. However, the accountability might not begin and end at the crash scene. Intoxicated driving accidents in Texas are unique in that there may be an accomplice who also needs to answer for their role in the crash: a negligent alcohol provider. Let me explain.
Simply put, it’s unlawful in Texas for bars, restaurants, stores, and other providers to serve people who are obviously intoxicated. If they do so, and that leads to people being seriously hurt or killed, the alcohol providers can be held accountable for their unlawful actions.
This is crucial for two main reasons. One, families deserve to see accountability when negligent behavior takes their loved one from them. That’s as true for a drunk driver behind the wheel as it is for a negligent establishment breaking the law and recklessly over-serving someone to the point of getting another person killed. Secondly, it’s important negligent alcohol providers stop their dangerous behavior before more people get hurt. In my experience handling hundreds of cases against negligent alcohol providers, they tend to clean up their act once they actually face consequences.
It’s possible that authorities will find that alcohol wasn’t the intoxicant here, or they may find there were no accomplices to this incident. That said, it’s important to rule these things out definitively through thorough investigations.
