Commentary by Attorney Michael Grossman
Following any serious accident, one of the key things people want is to be sure their side of the story will be told fairly. Sometimes, authorities are up to the task. Sometimes, they’re not. That’s why it’s important to consider some questions up front.
Did the authorities thoroughly investigate the crash?
A complete review would go beyond noting where the vehicles came to rest. It could include mapping the scene, checking for pre-impact tire marks, and determining whether either driver attempted evasive action. In single-lane departure cases, those small details can reveal whether the drift was gradual or sudden—an important distinction.
Has anyone looked into the possibility that a vehicle defect caused the crash?
Mechanical problems can cause a sudden loss of control without warning. Steering issues, brake malfunctions, or even electronic stability system errors could lead a vehicle to veer off course. A timely inspection of the Chevy would be critical to confirm or rule out those possibilities before repairs or salvage erase the evidence.
Has all the electronic data relating to the crash been collected?
Event data recorders may hold vital information about speed, steering inputs, and braking in the seconds before impact. Combined with any nearby camera footage, that data could make the difference between speculation and certainty. But it must be retrieved quickly before it’s lost.
If authorities can provide satisfactory answers, that’s generally a sign investigations were thorough. Otherwise, if answers come up short, then another set of eyes looking things over could reveal new details.
Takeaways:
- Lane departure crashes need precise scene analysis to spot sudden vs. gradual drift.
- Mechanical inspections can reveal failures that mimic driver error.
- Electronic and camera data should be secured promptly to preserve key details.
