Accident Report
March 13, 2026, Earnest Kelley was killed and two was injured after a semi-truck accident around 1:10 p.m. along FM 362.
Investigators said that the accident happened at the intersection of FM 362 and Garvie Road. Authorities said that 65-year-old Earnest Kelley was in a motor vehicle going southbound on FM 362. A semi-truck with two trailers was going northbound. Authorities say the truck failed to control speed, resulting in a chain-reaction crash. Earnest Kelley reportedly died due to the crash.
The accident involved a Ford F-250, and the driver of the Ford reportedly had serious injuries . A passenger from the pickup had moderate injuries. Occupants from a Mercedes-Benz apparently weren’t hurt.
Authorities recommended citing the truck driver for failure to control speed. Additional details are unavailable at this time.
How Did This Accident Occur?
If what police have said so far is true—that a semi failed to control speed—this all may sound pretty straight forward. But is that really all there is to this? A family loses a loved, one person has serious injuries, and authorities just cite the truck driver and that’s the end of it? In my experience, that’s usually only the end of the story if victims and families merely accept a surface-level analysis of what went wrong. When families demand a more thorough investigation, they’ll often find there is a lot more going on behind the scenes. Those new details may even lead to harsher consequences for those responsible for the crash. Let me explain.
Authorities are generally thorough when crashes require nothing more than a surface-level investigation. That typically includes mapping out the crash scene, speaking to drivers and witnesses, and maybe even pulling cellphone records. When a commercial truck causes a crash, however, the cause can trace back to actions taken long before the driver got behind the wheel.
For example, I handled a truck accident case a while back where a driver crashed after being behind the wheel for over 20 hours straight. That was obviously reckless, and authorities held the truck driver responsible for doing so. However, they never asked why the truck driver did that. We did, and we found out that the truck driver’s mistake was all but inevitable. It was the result of his employer’s reckless business practices.
That company expected their drivers to meet absolutely ludicrous deadlines. This meant drivers had to violate hours of service limits, skip regular maintenance, haul overweight cargo, make risky maneuvers to save for time, and otherwise cut corners everywhere they could to meet these deadlines. Drivers who took the time to be safe were punished. Drivers who broke the rules for the sake time were rewarded. Eventually, someone was going to get hurt or killed, and that’s exactly what happened.
To be clear, I’m not saying that’s what caused this crash. But have authorities bothered to look into why this truck driver supposedly failed to control their speed? Was it just a lapse in judgement? Were they working long hours? Did worn brakes or tires due to neglected repairs prevent the truck from slowing down? Was the driver speeding trying to meet a deadline? If authorities can’t answer these questions, then a mere citation might just be a band-aid that allows the root cause of the crash to continue putting lives at risk.
That’s what separates thorough truck accident reconstructions from run-of-the-mill crash investigations. In my experience, victims and families don’t just want a “bad guy” to blame. They want to see accountability, and if possible, they want to know help prevent other families from suffering the same harms done to them. If authorities are taking steps to ensure that sort of outcome here, that’s great. It’s just not something I ever take for granted. As such, it can be a good idea for victims and families to follow up with authorities as early as possible and find out if they’re asking the right questions.
