Commentary by Attorney Michael Grossman

When a single-vehicle crash results in serious injuries, like this one reportedly did, people often assume the cause is straightforward—maybe the driver was distracted, misjudged a turn, or overcorrected. But in my experience, those explanations are only the beginning. What looks simple on the surface can turn out to be far more complex once all the facts are known. That’s why it’s so important to ask three specific questions whenever a serious crash takes place.

First, did the authorities conduct a thorough investigation? In rural areas, particularly on farm-to-market roads, investigations can be limited by time, training, and available resources. Was the crash scene fully documented? Were roadway conditions, vehicle dynamics, and possible environmental factors analyzed? Without a detailed reconstruction, crucial pieces of the puzzle may be left out. And while most officers do the best they can under the circumstances, some aspects of an accident—like skid marks, impact angles, or mechanical faults—require a more specialized examination. That’s where independent investigators can play an essential role.

The second question is whether a defect in the vehicle may have contributed to the crash. When a driver takes what’s described as “faulty evasive action,” it raises an important follow-up: was the vehicle capable of responding properly? Problems with the steering system, brakes, tires, or suspension could easily compromise a driver’s ability to stay in control. But these types of defects aren’t always obvious at the scene. They require forensic analysis, and that can only happen if the vehicle is preserved in its post-crash condition. Once it’s been repaired or destroyed, any potential evidence is likely gone for good.

The final question is whether all electronic data related to the crash has been collected. Vehicles like the Toyota Tacoma are often equipped with event data recorders that can show speed, braking, and steering inputs in the moments before a crash. That data, along with any cell phone usage records or GPS tracking, can help clarify the sequence of events. Unfortunately, this information can be easily lost if steps aren’t taken quickly to preserve it.

In any serious crash, especially one where the cause remains uncertain, the best path forward is to ask the right questions—and to make sure someone is in a position to find the answers. Asking these questions is the least that can be done to ensure that those affected by this crash get the clarity and closure they deserve.
