Commentary by Attorney Michael Grossman

The cause of the crash isn’t confirmed right now. Regardless of what it is, though, my concern is the results of the crash. How is it that only one person was seriously injured here? Generally speaking, two people in the same vehicle flipping off the side of the road are going to fare more or less the same. There can be ordinary circumstances that might explain why someone’s injuries are more serious, but this kind of disparity is sometimes a red flag there was a defect.

Did the victim’s seatbelt function properly? Did their airbag go off? Did the structural integrity of the vehicle hold up as expected of a safe, modern vehicle? Was there anything wrong with the victim’s seat, such as a seatback defect, causing it to collapse? These aren’t exactly the most common factors, but decades of handling serious car accidents taught me never to ignore red flags. Unlikely or not, it’s better to rule something out than miss something authorities may have overlooked.
