Commentary by Attorney Michael Grossman

When a dump truck crashes into multiple vehicles, the legal questions start with why it happened, and more specifically, whether the driver was operating the truck safely and whether the truck itself was in safe condition to be on the road. Without more information, it’s impossible to draw conclusions, but there are a few areas I would expect any thorough investigation to explore.

First, did the truck’s brakes or steering system fail? Heavy commercial vehicles like dump trucks place a tremendous strain on those systems, especially in stop-and-go traffic. Mechanical failure is a common culprit in crashes like this, and determining whether a defect or lack of maintenance played a role is key.

Second, investigators should examine the driver’s actions. Was the driver distracted, fatigued or following too closely? Commercial drivers are held to a higher standard than everyday motorists, and rightly so. But if the driver’s training was lacking or if their employer pushed them to operate under unsafe conditions — tight deadlines, long hours or overloaded trucks — then the trucking company may bear some responsibility, too.

Lastly, the condition of the dump truck and its load should be reviewed. If the vehicle was improperly loaded or the cargo shifted in a way that made the truck unstable, that could have triggered or worsened the crash.

At this stage, the answers to those questions aren’t yet clear. But getting them will require more than a crash scene diagram. It will take vehicle inspections, company records and data from the truck itself, things that are easy to overlook unless someone insists on a full investigation.
