There are some key factors I have yet to see authorities discuss. Primarily: How visible was the disabled truck, and why did the mechanical issues occur? Let me give an example of why this all is so important and why typical investigations may not be enough to address what really went wrong here.

A while back, I had a case involving someone who crashed into the back of a disabled commercial vehicle. The company simply argued the victim wasn’t paying attention. Well, the evidence told a different story. That commercial vehicle broke down in the middle of a highway, and despite having plenty of time to put out cones or flares, the driver made no effort to make the vehicle visible. Not only that, but we delved into the company’s records and found that the mechanical issue was the result of months of neglected maintenance. The company simply avoided making necessary repairs in an effort to cut costs, and it inevitably led to preventable mechanical failure.

I’m not saying that’s what happened here, but these were details that authorities never talked about publicly. So all people saw were reports of someone rear-ending a stationary truck, and they assumed the victim wasn’t paying attention. Obviously, that’s a possibility worth considering. If this mechanical failure wasn’t foreseeable, and the truck driver did everything they could to safely stop the truck and make it visible for approaching motorists, then it wouldn’t be reasonable to put all of this on their shoulders. But if further investigations show that there were avoidable issues that led to this crash, that needs to be addressed.
