Commentary by Attorney Michael Grossman
When it comes to single-vehicle accidents, it often surprises people how often authorities treat them as a low priority. I get calls all the time from people who feel authorities either never bothered completing their investigations or were instead so focused on blaming someone that they jumped to conclusions without getting the whole story.
This is one of the reasons independent investigations are almost always more reliable after a serious car accident. They tend to ask the kinds of questions authorities overlook. Did the vehicle have any defects? Did a tire blow out? Are there nearby cameras that caught the crash on video? Does the vehicle’s Engine Control Module (ECM) data show anything about the crash? Are there issues with the road itself that explain what went wrong? Likely or not, these questions are worth considering. Perhaps authorities here have already considered these possible factors, but my experience taught me long ago not to take that for granted.
