Harris County, TX — December 5, 2023, a teenager was injured and Dora Acosta was possibly hurt as the result of a truck accident at 3:00 p.m. on Interstate 45.
Authorities said in their statements that the crash occurred along southbound lanes of the freeway in the area of Parker Road.

Preliminary information about the accident says that 41-year-old Dora Acosta and a 15-year-old girl were in a Toyota Camry going southbound on the North Freeway. In a series of events unclear, police say a tractor-trailer failed to control speed and crashed into the back of the Toyota. Due to the collision, the teenager had incapacitating injuries. Dora Acosta’s was said to be possibly injured.

In their reports, authorities said inattention may have been a factor, but it has yet to be confirmed. Frankly, that wouldn’t be surprising if evidence showed it to be true. But it can surprise folks just how challenging it can be to get that evidence.
I had a personal injury truck wreck case a while back, for example, where it was pretty damn obvious a truck driver was on his phone when he caused an accident. The authorities hadn’t done much to really dig into things, and the trucking company was actually claiming their driver didn’t have a phone at the time. We certainly weren’t buying that, but it was our burden to prove otherwise.
Fortunately, our team had dealt with similar stubborn companies in the past and knew how to prepare for them. A deposition was enough to put the screws to the driver until he tripped over his own stories and admitted he owned a phone and had it at the time of the crash. With that, we were able to get a judge to order the records be handed over. We were able to determine that the driver had been watching adult videos on his phone when he caused the crash (yes, really).
Maybe nothing so ridiculous happened here, but I wouldn’t be surprised if similar challenges came up here. They almost always do simply by virtue of the fact a commercial vehicle is involved. The key is to understand those potential challenges and to anticipate them properly.
