Harris County, TX — January 5, 2024, Don Flaminio was fatally injured due to an alleged intoxicated driver accident around 10:17 p.m. on Hempstead Road.
Harris County officials gave preliminary details about the crash, which they say occurred along the 36400 block of Hempstead Road.
According to officials, Don Flaminio was a passenger in a Mazda going along Hempstead. Police say that the Mazda was either making a right turn or a u-turn when a westbound BMW crashed into it. As a result of the collision, Don Flaminio sustained serious injuries and was taken to a hospital where he later succumbed to those injuries. There were no other confirmed injuries.

Right now, authorities say they believe the driver of the Mazda was intoxicated, and they reported a pending charge for intoxication manslaughter. Beyond that, there’s isn’t any other information available pending investigations. Depending on what further investigations bring to light, it’s very possible there will be more charges pursued in the near future. That could mean more are held responsible than just an alleged intoxicated driver.
Here’s why I say that. Our firm handles a lot of wrongful death cases all around the state of Texas involving intoxicated drivers who were over-served by negligent bars, restaurants, and other businesses. Departments that are thorough understand the importance of rooting out this behavior, and they tend to see both intoxicated drivers and negligent alcohol providers are held accountable whenever possible. Unfortunately, those departments are few and far between.
A lot of the time when we have wrongful death claims against negligent alcohol providers, the authorities haven’t even considered looking beyond the intoxicated driver’s mistakes, resulting in a lot of negligent businesses slipping through the cracks. Many of the times when our firm confronts an alcohol provider for their role in a deadly wreck, it’s the first time they’ve ever seen any kind of consequences for their actions, which is a shame since I’ve rarely seen an alcohol provider continue to make mistakes once they’re held accountable for breaking the law. They learn pretty quickly to clean up their act. So when authorities focus solely on one person’s actions without considering other potential accomplices, the reckless behavior that led to a serious accident can simply continue unchecked.
Just to be clear, I’m not saying I have any kind of inside info on this crash or that there was an alcohol provider involved in the accident. It’s not even confirmed right now whether authorities believe alcohol or drugs contributed to the crash. I’m just hoping to see authorities down in Harris County give this crash as much attention as it deserves. Otherwise, there may be slack to pick up to ensure there’s accountability for what happened here.
