When a vehicle leaves its lane and collides with a disabled 18-wheeler in the emergency lane, the key question isn’t just what happened, but why it happened. In my experience handling truck accident cases, wrecks like this often involve multiple contributing factors that need to be examined.
Why did the SUV leave its lane? Vehicles don’t typically drift out of control without reason. Did the driver experience a medical emergency, distraction, or fatigue? Did road conditions or an obstacle in the roadway force the driver to make a sudden maneuver? Investigators should review surveillance footage, phone records, and potential toxicology reports to determine what caused the SUV to veer off course.
Why was the 18-wheeler stopped in the emergency lane? While the shoulder is designated for breakdowns, not all disabled vehicles are stopped safely. Did the truck driver follow proper protocols, such as activating hazard lights or placing warning triangles? Investigators should determine whether the truck’s positioning and visibility contributed to the severity of the wreck.
Did mechanical failure play a role? If the SUV suffered a tire blowout, brake failure, or steering malfunction, that could explain why the driver lost control. Similarly, if the 18-wheeler had been parked due to a breakdown, investigators should determine whether poor maintenance or neglected repairs contributed to its presence in the emergency lane. Reviewing maintenance records and conducting post-crash inspections could help answer these questions.
Did broader issues contribute to the crash? Trucking companies are responsible for ensuring their vehicles are properly maintained and their drivers follow safety procedures when stopping on the highway. If a company ignored maintenance schedules, failed to enforce proper roadside safety protocols, or pressured a driver to keep operating a truck with known mechanical issues, those failures could have played a role in this crash. Investigators should review company policies, safety records, and past violations to determine whether broader issues need to be addressed.
At the end of the day, the most important thing is finding answers. Even if it takes an independent investigation to gather the right evidence, it’s critical to examine every factor to ensure those affected by the crash get the clarity and closure they deserve.
