Commentary by Attorney Michael Grossman

There’s still a lot of missing information here, but people have a tendency to quickly write off most pedestrian accidents—particularly those on or near a freeway. Frankly, I’ve heard “Either they were in a crosswalk or they were at fault” more times than I care to count. However, every accident including those with pedestrians deserves careful attention and investigation.

Until the full story is learned, it’s best not to jump to any conclusions. To find that story, many questions still need answers: How long was the victim in the road before the car passed through? Where did he come from before he entered the roadway? How visible was he—is that area well-lit at night? How fast was the car traveling? Were its lights on? Was anything wrong with it mechanically? Was the driver awake, alert, and paying attention to the road? Did other drivers successfully avoid the victim? Could anything else have been done to avoid the collision or reduce its damage?

I’m not pointing fingers or saying I know more than police about what happened. I’m only saying what I so often do: The few known or theorized details offered during early investigations rarely contain everything there is to know, and it’s important not to treat them as the final word. The victim’s loved ones deserve as much of the story as investigators can find for them; I just hope whoever’s assigned to this accident is up to the task.
