El Paso, TX — April 14, 2024, Derek Limon was killed and Elizabeth Chagra-Nichols and one other were injured in a car accident at 2:30 a.m. on Trowbridge.

Investigators said in initial statements that the accident took place in the area of the Paisano Drive and Trowbridge Drive intersection.

According to officials, 26-year-old Elizabeth Chagra-Nichols and 26-year-old Derek Limon were in a Kia Forte going southbound on Paisano. A 50-year-old woman was in an Oldsmobile going westbound on Trowbridge. At the crossing, officials say that the Kia and the Oldsmobile collided. Due to the collision, Limon sustained injuries that ultimately proved to be fatal. Chagra-Nichols and the woman in the Oldsmobile both reportedly had serious injuries.

At this time, details suggest alcohol was a factor in the crash. If that’s true, it wouldn’t be surprising, given 2:30 a.m. is when a lot of people are trying to go home after a night out at the bar. That brings up the vital question: did authorities investigate where the alcohol came from? Here’s why that matters.

I’ve handled hundreds of cases involving drunk drivers, and it’s all too common this sort of crash involves a negligent alcohol provider that illegally over-served someone. Those negligent alcohol providers can be held responsible for their role in an accident, opening themselves up to potential criminal investigations, fines, license suspensions, and liability for the resulting injuries or deaths. It’s frankly not the sort of thing authorities are often motivated to look into on their own, so seeing appropriate consequences for an accident like this often relies on more thorough independent investigations.
