Commentary by Attorney Michael Grossman

I’m going to be rather blunt here and ask a question I too often find myself asking in this line of work: Did authorities give this accident the attention it deserved?

What I’m seeing here is information claiming that a truck went onto the improved shoulder, and at some point a man was hit and killed. People tend to read about someone hit on the interstate and just assume that the victim was in the wrong. But if they were safely on the shoulder out of the way of traffic, it raises serious red flags that a vehicle may have left their lane of travel and hit that person. Is that order of events accurate? And if so, why did that happen?

Was the truck driver swerving to avoid something? Were they fatigued and falling asleep at the wheel? Were they on their phone, drifting in and out of their lane? Were they trying to pull over, and this was just an unfortunate case of being in the wrong place at the wrong time? Was the victim near a broken down vehicle? Were they in a well-lit area? Did the truck have a dash cam that could help shed light on what happened? Are authorities even sure about the order of events surrounding the accident?

These are the kinds of questions I’m just coming up with off the top of my head after reading about a preliminary investigation. In my experience handling hundreds of commercial truck accident cases, this barely scratches the surface of questions a family has after the death of a loved one. It’s possible that authorities have taken steps behind the scenes to ensure this man’s family is getting the answers they deserve. However, it’s not unusual for people to follow up with authorities only to be unsatisfied with the answers they’re getting. That’s when there may need to be a second set of eyes to look things over and ensure nothing important slipped through the cracks. One way or the other, the goal should be for the family to know they’re getting the whole story.
