Commentary by Attorney Michael Grossman

With single vehicle wrecks, one of the most common mistakes is assuming the driver did something wrong. To be clear, it is common for this sort of thing to be the result of driver error. But there can be extenuating circumstances that even authorities may overlook in their investigations.

What if there was a mechanical issue? What if a tire blew out? What if the driver was unlawfully over-served by an alcohol provider? What if they experienced a medical emergency? What if some other reckless driver ran them off the road and fled the scene?

Common or not, these things happen. Instead of looking for someone to blame, it’s best to get clear evidence and let it speak for itself. Otherwise, there’s a risk of important details slipping through the cracks and a grieving family not getting the answers they deserve. Were authorities careful to avoid that risk, or have they not given this accident the attention it needs?
