Commentary by Attorney Michael Grossman
These are obviously serious allegations. Even if they’re proven to be true, though, folks may be a bit too quick to assume everything here will be open-and-shut. If someone was drunk, there will be blood tests, charges, and that will be that, right? Well, alcohol-related accidents often involve more than just a drunk driver. There also should be investigations into where that driver was prior to the accident. Evidence could show there’s an alcohol provider complicit in the crash, as well.
Simply put, if an alcohol provider unlawfully over-serves someone who is obviously intoxicated, they potentially expose themselves to criminal investigations, fines, suspended licenses, and liability for the resulting injuries. Not only can these potential avenues see there’s accountability for an alcohol provider’s negligence, but it can also get them to clean up their act so their behavior doesn’t go on to harm others.
My concern, though, is that authorities often get tunnel vision with alcohol-related accidents. They focus so much on the drunk drivers that they let complicit negligent alcohol providers slip through the cracks. I can’t count how many of the hundreds of cases I’ve had against negligent alcohol providers where police investigations began and ended at the crash scene. Hopefully, authorities here have been more thorough and took steps to investigate all of the events leading to this serious accident. Otherwise, there could be more to this story the victim and their loved ones need to know about that isn’t getting the attention it deserves.
