Commentary by Attorney Michael Grossman

Crashes where a passenger vehicle collides with the trailer of a semi-truck raise an important question: Was the trailer clearly visible and properly marked? At first glance, it might seem like the pickup driver simply failed to see and avoid the trailer, but in my experience, these kinds of crashes often involve factors beyond just driver error.

One of the first things investigators should examine is whether the trailer had proper lighting and reflective markings. Federal regulations require semi-trailers to have reflectors and lights that make them visible to other drivers, especially at night. If those weren’t working or were missing altogether, the pickup driver may not have had enough time to react before the collision. That’s a critical factor that should not be overlooked.

Another issue worth investigating is whether the trailer was in motion or stopped at the time of the crash. If the truck was pulling onto the highway or making a turn, was it blocking a lane of travel? Did the truck driver give approaching vehicles enough time to react? I’ve seen cases where truckers misjudge gaps in traffic or take too long to complete a turn, leaving other drivers with nowhere to go. If something like that happened here, then some responsibility may fall on the truck driver.

Crashes like this often seem straightforward, but once you start looking at the details, they get a lot more complex. Hopefully, investigators take the time to examine all the factors at play here, rather than settling for the easiest explanation. The victim’s family deserves to have answers to all of their questions about this crash.
