The pickup driver now reportedly faces a charge for intoxication manslaughter due to the accident. If the allegations are true, have authorities looked into what events led up to the accident? With intoxicated drivers, there is often an accomplice beyond the immediate crash scene who slips through the cracks without thorough investigations. Specifically, if evidence shows the driver was drunk, then the alcohol provider who provided the alcohol may be responsible for the crash, as well.
It’s illegal in Texas for bars and other providers to over-serve people who are obviously intoxicated. Doing so exposes establishments to potential criminal investigations, fines, license suspensions, and liability for resulting accidents. But I’ve handled hundreds of cases against negligent alcohol providers. It’s rare that authorities are ever looking into the providers before anyone else despite investigating the accidents before anyone else. It’s far more common negligent establishments only face consequences because victims and families pursued legal avenues independent of the authorities. Otherwise, the providers are simply let off the hook.
It’s not yet confirmed if this crash involved alcohol specifically, but it’s important to consider these possibilities sooner rather than later. After all, families don’t just want some bad guy to blame and an easy explanation of what happened. They want the whole story, and they want to know all parties responsible for the death of their loved one will be held accountable. Are those steps being taken here?
