Commentary by Attorney Michael Grossman

Sometimes people see a “stopped vehicle” involved in a crash and assume the vehicle moving must have done something wrong. However, context matters. Why was the truck stopped in the road? Was it waiting to turn? Was it parked without emergency lights on? Was it broken down? These and other potential reasons can have vastly different legal implications.

For example, take a case I handled a while back involving a stopped commercial vehicle in the roadway. Our investigations revealed several serious mistakes the CMV driver made leading up to that crash. For one, they never put out cones or flares to mark their vehicle. Two, the truck stopped due to a mechanical issue that was the result of months of neglected repairs that easily could have been solved. And lastly, the driver could have continued driving out of the roadway, but they panicked and stopped immediately, needlessly blocking lanes of travel.

In a situation like that, a victim wouldn’t be responsible just because they were the ones in the moving vehicle. At the end of the day, it’s important to understand what domino fell that started the whole deadly chain of events. That’s why It’s important crashes like this get thorough investigations so there can be a full recounting of the events leading to the collision. If authorities don’t do that on their own, then that’s when independent investigators may need to step in to fill in the blanks.
