Commentary by Attorney Michael Grossman

When a fatal collision occurs, particularly one involving risky maneuvers like passing in a no-passing zone, a thorough investigation is critical to understand how and why it happened. In my experience, incidents like this require careful attention to three key questions.

First, did the authorities thoroughly investigate the crash? Passing in a no-passing zone typically indicates a hazardous situation, but understanding why it occurred requires a closer look at the circumstances. Investigators should analyze evidence such as tire marks, debris, and the vehicles’ final resting positions to reconstruct the events leading to the collision. Witness statements and any available surveillance or dashcam footage could provide additional context, particularly regarding whether speed, distractions, or limited visibility played a role in the truck’s decision to pass.

Second, has anyone considered whether a vehicle defect might have contributed to the crash? While attempting to pass in a prohibited area suggests driver error, mechanical issues such as brake or steering failures cannot be ruled out without a thorough forensic examination of the Chevrolet Colorado. Additionally, investigators should review the safety systems of both vehicles, including seat belts and airbags, to determine whether they functioned as intended to protect their occupants during the collision.

Finally, has all relevant electronic data been collected? Both the Chevrolet Colorado and the Chevrolet Suburban are likely equipped with event data recorders (EDRs) that capture critical information such as speed, steering, and braking inputs leading up to the crash. This data can help clarify whether the truck’s movements were consistent with driver input or indicative of mechanical failure. If available, nearby traffic camera footage might also provide a clearer picture of the roadway and conditions at the time of the accident.

Accidents involving severe outcomes, such as fatalities and significant injuries, demand comprehensive investigations to uncover all contributing factors. By addressing these questions, investigators can work toward providing a clearer understanding of what happened and why. A thorough investigation is the least that can be done to ensure every possible factor is carefully examined. For the loved ones of Daniel Lee and for the injured woman in the Suburban, obtaining these answers is an essential step toward clarity and closure.
