How Did This Accident Occur?
People generally think that the only factor that matters in these situations is who had the right-of-way. Was the pedestrian in a crosswalk, or weren’t they? That’s obviously important, but it’s far from the only important factor to consider.
For example, let’s say that someone is in the middle of a roadway, but they’re clearly visible and far enough away that a driver should be able to slow down or go around them. Would it be reasonable to allow a driver to run them down just because the pedestrian wasn’t in a crosswalk? Of course not. That would be ridiculous. It would be equally ridiculous to automatically assume that a driver is in the wrong just because a pedestrian is standing in a piece of road that happens to have paint on it.
That’s why it’s important for investigators to consider the full context after a crash like this. Who had the right-of-way? How fast was the vehicle going? What was lighting like? Did the driver have time to react? Was alcohol a factor? Was there some kind of emergency going on? Either authorities can provide these answers, or independent investigators can step in to handle what authorities couldn’t or wouldn’t do themselves.
If anyone’s local to the area, is pedestrian traffic common at this intersection? Let me know in the comments.
