Commentary by Attorney Michael Grossman
When I hear about a crash where a passenger vehicle collides with a semi-truck near an intersection, my first question is, “What led to the two vehicles crossing paths?” Many people might assume the smaller vehicle was at fault, but in my experience, crashes like this often involve factors beyond just driver decisions.
One of the first things investigators should determine is whether either driver had the right of way. Was this a controlled intersection with traffic signals or stop signs? If so, did either driver fail to obey those controls? If it was an uncontrolled or poorly marked intersection, that could create confusion about who was supposed to yield.
Speed and stopping distance should also be examined. Semi-trucks require more time to slow down, and depending on the angle of the crash, investigators should look at whether the truck was traveling at a safe speed for the intersection. Reviewing ECM (black box) data from the truck could help determine if the driver attempted to brake or was already committed to a turn when the collision occurred.
At this stage, it’s too early to say exactly what caused this crash. That’s why a full investigation needs to consider all possible contributing factors, rather than making assumptions based solely on who appeared to hit whom. A careful review of the available evidence is the only way to get a clear picture of what happened.
