Houston, TX — February 6, 2024, Cuong Manh Bui was injured following an alleged hit-and-run accident at around 10:55 p.m. on Interstate 45.

According to initial details about the crash from authorities, the crash happened along northbound lanes of the North Freeway in the area of Highway 249 interchange.

Investigators stated that 63-year-old Cuong Manh Bui was in a Toyota Highlander traveling along I-45. While doing so, authorities say that a Kia Soul struck Bui’s vehicle from behind. As a result, Bui sustained what Harris County officials referred to as possible serious bodily injury.

Statements from investigating officers said the Kia driver was arrested for being under the influence of alcohol, however county officials only released information on a charge for failure to stop and render aid. Any mention of alcohol usually comes with drunk driving charges, but there could be extenuating circumstances here. For example, I’ve seen situations where a drunk driver leaves the scene, so authorities aren’t able to get a blood test until the suspect’s sobered up.

Now, a BAC result isn’t the only important factor to consider, of course. Our firm, for instance, has proved many drivers were intoxicated using things like witness statements, credit card records, security video, texts, and even social media posts. However, the standard of proof in a personal injury case against a bar is lower than in criminal courts, so authorities may be less confident in their ability to get a conviction without a clear BAC result to rely on.

I’m not saying anything like that happened here, but it can help to know that seemingly unusual circumstances can have reasonable explanations.
