Commentary by Attorney Michael Grossman

When accidents like this one occur, the focus often rests solely on the immediate collision, with little attention paid to what may have caused the events to unfold in the first place. Having spent decades handling cases involving commercial vehicle accidents, I’ve found that the real story is rarely as simple as it seems at first glance.

In this case, the details provided suggest that the 18-wheeler was stopped at the time of the collision. What’s less clear is why. If the truck was halted because of another vehicle ahead of it, why couldn’t the Ford Focus stop in time to avoid a crash? Did poor visibility or distraction play a role, or did the truck stop in a way that gave oncoming vehicles insufficient warning? These are questions that require thorough investigation to determine how this tragic chain of events began.

It’s also worth considering whether the truck itself was positioned in a way that maximized safety. Large vehicles are required to use specific warning devices like reflective triangles or flares to alert approaching drivers when stopped in or near active lanes of traffic. Were such measures in place here? Additionally, were the truck’s lights and reflective materials functioning and clearly visible? Any deficiencies could significantly increase the likelihood of a rear-end collision.

The role of the trucking company must also be scrutinized. Companies are responsible for ensuring their vehicles and drivers adhere to strict safety protocols. Was the driver operating under company-imposed pressure to meet tight deadlines, possibly leading to unsafe decisions? Did the company ensure the truck was properly maintained and the driver adequately trained for such situations? The answers to these questions could reveal whether corporate practices contributed to the accident.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure those impacted by the incident receive the clarity and closure they deserve.
