Commentary by Attorney Michael Grossman

One thing that stands out to me here is that only one person was seriously injured. Generally speaking, when two similar-sized vehicles collide, injuries of the people involve will be comparable. Circumstances could reasonably explain this disparity in severity of injuries, but it’s sometimes a red flag that there was something specific about the victim’s vehicle that led to the injuries.

For example, an airbag may not have deployed correctly. A seatbelt may not have locked when the collision happened. The victim’s seat assembly may have broken loose. There are far from typical factors, and authorities aren’t likely to catch them. Independent accident reconstructions are usually necessary to bring something like a defect to light and make sure it gets attention.
