Upshur County, TX — July 24, 2024, Colt Rosewell and three others were injured following an alleged drunk driver accident at around 9:30 p.m. along U.S. 271.

According to initial details about the accident, it happened in the area of Antelope Road, north of Gilmer.

Investigators said that 31-year-old Colt Rosewell and three others were in a Jeep Wrangler going northbound on the highway. From the southbound lanes, it appears a Dodge Dakota went across the center of the highway and crashed into Rosewell’s vehicle. As a result, Rosewell and all three passengers in the Jeep had reportedly serious injuries.

The other driver is accused of being under the influence of alcohol at the time of the accident, and authorities recommended charges for intoxication assault. If that’s true, have authorities also looked into where the alcohol came from? As important as it is for drunk drivers to face consequences, they often an accomplice in these situations: a local alcohol provider.

Put simply, it’s illegal in Texas for bars, restaurants, liquor stores, and other such establishments to serve someone who is obviously intoxicated. Doing so exposes those alcohol providers to potential criminal investigations, license suspensions, fines, and liability for the resulting injuries. Too often, though, these negligent establishments get off scot-free because no one bothers looking for them. Authorities tend to put all of their attention on the drunk drivers. Meanwhile, the complicit alcohol provider who over-served them gets to continue unpunished, likely putting other lives at risk.

That’s why these accidents always stand out to me. Having worked with hundreds of victims and families to hold negligent alcohol provider liable after serious accidents, I know that people are just as keen to see establishments answer for their actions as they are to see drunk drivers answer for theirs. After all, they don’t want some bad guy to blame. They want accountability. And if authorities here care about that, as well, they should already be considering the possibility there’s more than just an individual drunk driver responsible for all of this.
