Commentary by Attorney Michael Grossman
When crashes like this occur, people often assume they are the result of a brief lapse in judgment by one of the drivers involved. However, in my experience handling cases involving commercial vehicles, such incidents are rarely so simple. Accidents like these often result from a chain of circumstances that merit closer examination to determine what truly went wrong.
In this case, the focus must be on why the 18-wheeler reportedly attempted a lane change at an unsafe time. Was the truck driver distracted or perhaps unaware of the smaller vehicle in the adjacent lane? Did the truck’s mirrors or sensors fail to provide adequate visibility, or was the driver’s judgment impaired by fatigue or other factors? These are essential questions to ask, as they can shed light on whether the crash was the result of a momentary error or deeper systemic issues.
The trucking company also warrants scrutiny in this situation. Commercial vehicle operators bear significant responsibility for the safety of their vehicles and drivers. Were proper protocols followed to ensure the Peterbilt was in good working condition, including functional mirrors and warning systems? Did the company provide adequate training to the driver to handle lane changes safely, particularly on busy highways? Furthermore, were unreasonable schedules or delivery deadlines contributing to driver fatigue or risky decisions? A thorough investigation could determine whether the trucking company played a role in what happened.
The truck itself is another critical area to investigate. Commercial trucks are often equipped with advanced safety features like lane departure warnings or blind spot monitoring systems. Were such features present on this vehicle, and if so, were they operational at the time of the crash? Similarly, reflective markings, turn signals, and other safety measures should be evaluated to confirm they were functioning as intended. A failure in any of these systems could be a key factor in the collision.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure that Clyde Morales and his family receive the clarity and closure they deserve.
