Commentary by Attorney Michael Grossman

According to authorities, the driver of the Toyota had allegedly been drinking, and they recommended a charge for DWI. I can’t help but wonder if there’s more to this story to shed light on why authorities didn’t recommend more serious charges.

Generally speaking, I’m used to authorities overlooking things like negligent alcohol providers. I can’t begin to count how often our firm has had a personal injury case against a bar responsible for their role in a crash who broke all kinds of laws, yet authorities only ever went after the drunk driver. But usually, when police accuse someone of drinking and causing serious injuries, they’ll recommend more serious charges, such as intoxication assault.

There could certainly be a reasonable explanation here, such as authorities taking further steps outside of the public eye. I just have to wonder if this is a situation that may not be getting the attention it deserves.
