Commentary by Attorney Michael Grossman
There isn’t a lot of information about what happened here, but I saw some footage in the news that stood out to me. In the footage, it appears that the truck involved here was perpendicular to lanes of travel along Louetta. That makes me wonder if the truck was making a turn or attempting to cross the roadway when this collision happened. That may sound like a detail authorities already would have taken into account for their investigations, but authorities unfortunately don’t always take motorcycle accidents seriously. That’s when important details may slip through the cracks.
Simply put, a lot of people are biased against motorcyclists. Despite the fact most riders are safe, responsible drivers, folks just assume they must have been behaving recklessly regardless of whether or not they have evidence to support their conclusions. Officers are not immune to this bias, and less-experienced officers may not take the steps necessary to put that bias aside and let the evidence speak for itself. This can lead to situations like a case I had a while back where officers blamed a motorcyclist for reckless driving, but our independent accident reconstructions provided clear evidence to the contrary. Had there not been further investigations, there’s no telling if the truth ever would have come to light.
Again, authorities could be conducting thorough investigations here. Ultimately, if a family feels all of their doubts and questions are being adequately addressed, it’s likely a sign authorities are doing a good job. The concern should be when the details aren’t adding up and there are still gaps in the story. That can be a sign that the efforts of authorities alone are coming up short.
