Despite what some may think, a driver being charged for DWI does not automatically make a situation open-and-shut. In fact, it could raise unique and complex challenges. For example, was alcohol the alleged intoxicant here? If so, that could mean there’s a negligent alcohol provider responsible for contributing to the accident.

In short, Texas dram shop laws prohibit alcohol providers from serving alcohol to someone who is obviously intoxicated. If the driver in this case had been drinking at a bar or restaurant before the crash, investigators might find that establishment over-served them. If an alcohol provider ignored their legal responsibility and continued serving the driver past the point of obvious intoxication, they may share responsibility for what happened.

This all depends on evidence which isn’t clear right now, so hopefully steps are taken to continue investigating this accident. At the end of the day, the victim’s loved ones deserve to know all wrongdoers involved in the accident will face appropriate consequences.
