Commentary by Attorney Michael Grossman

If the claims made by authorities here are true, one has to wonder what led to a professional truck driver failing to yield during daylight hours at what appears to be a pretty wide-open intersection. That “why” is something that too often goes overlooked, as people tend to see someone blamed for a crash and feel everything is open-and-shut. However, a mistake like this is rarely isolated. More often, there are existing issues behind the scenes that need to be called out.

I’ve handled hundreds of commercial vehicle accident cases, and truck drivers making mistakes can be a sign that their employers are engaging in reckless behavior. Drivers may be pushed to meet unreasonable deadlines. They could be distracted due to overbearing supervisors blowing up their phone. They might be inexperienced drivers who were rushed through the training process. Some companies even hire drivers with a history of negligent driving, but they ignore that just to get trucks moving.

Here’s why this all really matters. In my experience, folks don’t just want some “bad guy” to blame. They want to see accountability. If that’s just one truck driver making an isolated mistake, then that’s that. But if that mistake was the result of problems that existed long before that driver got behind the wheel, those issues need to be addressed before more people get hurt.
