Commentary by Attorney Michael Grossman
When reviewing incidents like this, it’s important to consider the steps that could help prevent similar crashes in the future. Authorities allege that the driver of the Chevy Equinox was intoxicated and fled the scene after the collision. If true, this raises critical questions about where and how the driver consumed alcohol before the crash.
Under Texas law, it is illegal for alcohol providers to serve patrons who are obviously intoxicated. If the driver had been overserved at a bar, restaurant, or other establishment before getting behind the wheel, that establishment could share responsibility for the injuries caused in the crash. Dram shop laws exist to hold such establishments accountable, not just for the sake of those harmed but to promote safer alcohol service and reduce drunk driving incidents.
In many cases, drunk drivers are served well past the point of intoxication, despite clear signs that they should no longer be drinking. Investigating where the driver had been prior to this crash is essential to understanding the full scope of what led to this incident. Identifying all contributing factors, including any unlawful alcohol service, can help ensure accountability and reduce the risk of future accidents.
For Christopher Barrera and others affected by incidents like this, getting the full truth about what happened is key. Holding all responsible parties accountable, including any alcohol providers who may have contributed to the driver’s intoxication, is an important step toward making Texas roads safer for everyone.
