Commentary by Attorney Michael Grossman
When reviewing an accident like this, it’s essential to take a closer look at how and why the commercial vehicle reportedly failed to maintain its lane of travel. Based on the updated information, it appears the box truck veered left-of-center, entering opposing traffic and causing a devastating head-on collision with the Chevrolet Malibu. However, the details behind that loss of control remain unclear, and determining exactly what happened will require a detailed investigation into all contributing factors.
From my experience handling commercial vehicle cases, these situations often involve multiple layers of responsibility. First, what caused the box truck to veer into the opposing lane? Was the driver distracted, fatigued, or impaired? Did they overcorrect in response to an obstacle or another hazard on the road? The driver’s condition, actions, and decision-making leading up to the crash are critical pieces of the puzzle that must be thoroughly examined.
At the same time, it’s equally important to scrutinize the truck itself. Was the vehicle properly maintained, with fully functioning brakes, tires, and steering mechanisms? If the truck’s mechanical systems failed or its load was improperly secured, those failures could have played a key role in the loss of control. Commercial trucks are held to strict safety standards under federal regulations, and any failure to meet those requirements could indicate negligence on the part of the trucking company.
Speaking of the trucking company, their role deserves particular attention. Were they enforcing reasonable driving schedules and ensuring the driver was properly rested? Did they provide adequate training and maintain their vehicle fleet to the standards required by law? It’s not uncommon to uncover that companies cut corners on safety, often to save money or meet deadlines, and those lapses can have catastrophic consequences for the people their drivers share the road with.
Ultimately, a thorough investigation is the least that can be done to ensure all the facts are uncovered and accountability is determined. Even if it requires independent investigation, it’s only through such careful means that the family of Ms. Roberts can receive the clarity and closure they deserve.
