Commentary by Attorney Michael Grossman

One key detail that needs to be addressed is where this animal came from. Generally speaking, livestock owners can’t completely control the actions of an animal. They’re just animals, after all. However, they do owe a basic duty to take reasonable precautions to prevent animals from getting out onto the roads.

If, for example, a property owner wasn’t maintaining their fence line properly, an animal escaping through damaged fencing would be a completely predictable and therefore preventable result of their negligence. On the other hand, if a fence is damaged in a storm, and an animal escapes during that storm before the owner could have ever fixed the problem, it’s unlikely they would be responsible for that.

So with this accident, it’s important to know where this horse came from, how it got out onto the roadway, and whether or not that was preventable. Right now, I don’t see any sign that’s something authorities have looked into.
