Commentary by Attorney Michael Grossman

After a fatal accident, one of the biggest concerns families face is whether the full story will be told, not just a quick version that only focuses on blame. A good way to get that clarity is by asking the right questions about how the crash is being investigated.

Were authorities thorough in documenting the scene—mapping skid marks, impact points, and pre-crash vehicle movement—or did they only gather the basics? Were the vehicles inspected for possible defects, like brake failures or malfunctioning airbags and seatbelts, that could have influenced both the cause and the severity of the crash? And was electronic evidence preserved, such as Engine Control Module data, cellphone records, or nearby traffic camera footage?

If it seems authorities have answers that address all concerns and doubts, that’s a good sign they’re taking everything seriously. But when it seems their answers aren’t adding up, that’s when it may be time for more thorough independent investigators to step up to the plate.

Takeaways:

  • A surface-level crash report often leaves out critical details.
  • Vehicle inspections can reveal failures that affect both cause and outcome.
  • ECM data, phones, and cameras provide evidence that can confirm what really happened.
