Commentary by Attorney Michael Grossman

If the recent details are true, then I have to wonder what evidence authorities found to file such serious charges. In the meantime, though, it’s important not to see this as open-and-shut simply because someone is being charged. There could still be more to the story, as commercial vehicle accidents almost always involve several layers beyond just a driver making a mistake.

Specifically, what role did an employer play in this accident? I’ve handled hundreds of commercial vehicle accident cases, and many companies out there create an environment in which a mistake is inevitable. As such, investigations have many factors they should address. Was the driver distracted by equipment? Are they inexperienced? Do they have a history of reckless behavior? Does the truck not have appropriate mirrors or other safety features? Was the driver rushing due to unreasonable deadlines?

At the end of the day, these are just some of the questions a proper commercial vehicle accident reconstruction should include. That’s why a good rule of thumb for folks is to consider how thorough the authorities are being. If a family feels that all of their questions are being answered, then authorities are likely doing a good job. But if they find themselves with doubts and unanswered questions, there may be something important slipping through the cracks.
