Commentary by Attorney Michael Grossman

With incidents like this in public pools, people often put all of their focus on things like supervision and lifeguards. These are important details, obviously. However, other factors must be considered. Did the pool have exposed electronics? Are there obstructed sight lines? Is the condition of the pool poor or in disrepair? Are there issues residents in the community have expressed before? Have their been other similar incidents here? These are the kinds of questions not only necessary for a family in need of answers but also to help ensure this kind of thing doesn’t happen again.
