Chassity Hall, Courtney Hamilton, Child Injured in Alleged Drunk Driver Accident in Willow Park, TX

It appears that 35-year-old Chassity Hall and a toddler were in a GMC Acadia and 40-year-old Courtney Wade Hamilton was in a Ford F-150. Both were going eastbound in the left lane of travel through a construction area. A Chevy Silverado approaching from behind reportedly did not slow down in time, crashing into the GMC and pushing it into the back of the Ford.

Due to the collision, both Hall and Hamilton had apparently serious injuries. The child in the GMC reportedly had moderate injuries. There were no other reported injuries.

Commentary by Attorney Michael Grossman

At this time, authorities allege that the Chevy driver was under the influence of alcohol, and they recommended charges for intoxication assault. If those are true, they may only explain part of what the victims and families need to know after a drunk driving wreck. Holding a driver accountable for driving drunk is obviously important. But there’s usually more to the story. Oftentimes, there’s also a negligent alcohol provider responsible for illegally over-serving the driver. Was there an alcohol provider here that played a role in these victims’ injuries?

Unfortunately, that’s not a question authorities tend to answer. Their investigations often begin and end at the crash scene. I’ve had hundreds of cases holding negligent alcohol providers liable for their role in a serious crash. The victims and families in many of those cases never even knew a bar, restaurant, or liquor store might be involved. In other words, those establishments who broke the law and had a hand in causing serious harm would have been able to continue business as usual like nothing happened had it not been for the people they harmed seeking out help independent of the authorities.

Maybe nothing like that ultimately applies to this situation, but it’s important the evidence has the last word on that. After all, folks are rightfully keen to see drunk drivers held accountable for their actions. That shouldn’t mean letting others off the hook when Texas law provides clear avenues to see they, too, face appropriate consequences.
