Commentary by Attorney Michael Grossman
Whatever ultimately caused this accident, the reality of work fatalities in Texas is that they are pretty much always incredibly challenging to resolve. Texas has the most complex work fatality law in the country. This is due to the fact that companies are not required to subscribe to the workers’ comp system. As such, where people often believe there will automatically be benefits to support a worker’s family, there sometimes is no guaranteed path to get those benefits. That leaves families in a position where they have seek the help that they need from a company whose interests are far from aligning with theirs. It’s possible to navigate this legal maze, of course, but that requires a lot of experience and legal maneuvering. The sooner steps are taken to anticipate such challenges, the better the chances will be of a family getting the resolution they deserve.
