Commentary by Attorney Michael Grossman
t’s worth asking: how does someone end up allegedly racing through a busy roadway while intoxicated, especially with children in the car? That’s not just a question about the driver’s choices. It’s also a question about where that driver got their alcohol in the first place.
More often than not, when a person is accused of driving drunk, they’re coming from a bar or restaurant. And under Texas dram shop laws, it’s illegal for alcohol providers to serve someone who’s obviously intoxicated. When they do, and that person goes on to hurt others, the law allows those affected to hold the provider accountable.
That’s why it’s critical to investigate not just the crash itself, but also where the alcohol came from. If an establishment overserved the driver before this wreck, that needs to come to light, not just for the sake of the people injured here, but to help prevent the next crash from happening. Holding all responsible parties accountable is how we make our roads safer for everyone.
