Commentary by Attorney Michael Grossman

When a head-on collision between a motor vehicle and an 18-wheeler results in the loss of life, a detailed investigation is essential to uncover all contributing factors. Based on my experience, addressing three critical questions can help ensure the full scope of the crash is understood: Was the crash thoroughly investigated? Could a vehicle defect or maintenance issue have contributed? And has all relevant electronic data been secured to clarify the events leading up to the collision?

First, was the crash thoroughly investigated? A head-on collision raises immediate concerns about why one vehicle crossed into oncoming traffic. Did investigators examine whether the roadway conditions, such as faded lane markings, poor lighting, or any hazards, might have contributed? Additionally, did they assess whether fatigue, distraction, or other driver factors may have been involved? Accidents on rural highways like U.S. 57 can sometimes involve long stretches of uninterrupted driving, which can increase the risk of fatigue-related incidents. Understanding these dynamics is essential to piecing together what went wrong.

Second, could a vehicle defect or maintenance issue have contributed? When a vehicle drifts out of its lane, mechanical factors such as a tire blowout, steering failure, or brake malfunction could be to blame. Was the vehicle inspected for any signs of defects, overdue maintenance, or manufacturing issues? Similarly, 18-wheelers are subject to strict maintenance regulations, so it’s equally important to confirm whether the truck’s braking system, tires, or other components were in proper working order. These questions must be thoroughly addressed to ensure that no mechanical factors were overlooked.

Finally, has all relevant electronic data been collected? Both the motor vehicle and the 18-wheeler involved in the collision likely contained event data recorders (EDRs), which can provide key insights into the crash. These devices can record critical information such as vehicle speed, steering inputs, braking activity, and more in the seconds leading up to the collision. Additionally, any available dashcam footage or traffic camera recordings could shed light on the sequence of events and help clarify what caused the motor vehicle to cross into oncoming traffic.

Accidents involving fatalities demand a meticulous investigation to uncover every contributing factor. By addressing these questions, investigators can build a clear picture of what happened and why. For the loved ones of Carmen Ruiz, obtaining these answers is an essential step toward clarity and closure.
