Commentary by Attorney Michael Grossman
A concern in any crash involving a commercial vehicle should be how the investigations are being handled. Frankly, they can be complex enough that simply relying on authorities to get answers could lead to important details slipping through the cracks. While they may generally have the tools and experience to look into things like speeding, intoxication, and distracted driving, there are many other factors which could be beyond their ability to investigate.
What was the condition of the road? Did poor vehicle maintenance lead to the crash? Did any of the vehicles experience mechanical issues due to a defect? What does the truck’s Engine Control Module (ECM) data say? Does the crash involve a company that has been involved in other fatal wrecks? Is there video evidence that can be subpoenaed? What details would a reconstruction of the crash scene reveal about the moments leading to the collision?
It might surprise folks how often authorities simply never ask these questions. Even if an officer is experienced enough to do so, their department may not provide them with the tools they need to do the job right. It’s one of the reasons my job is so reliant on independent accident reconstructionists whose experience and equipment can fill in those gaps and make sure all the facts come to light. Sometimes, those investigations confirm everything police already know, which itself can be a weight off a family’s shoulders. Other times, it can show there is more to the story that the victim’s loved ones had yet to hear. Whatever ultimately led to this crash, the victim’s loved ones at least deserve to know they’re getting the full story. That’s why it may be necessary to consider those questions asked above and whether or not authorities are able to get the answers.
