Commentary by Attorney Michael Grossman

Single-vehicle accidents can present unique challenges which authorities aren’t always able to handle on their own. Things aren’t always just about speed or possible distracted driving. There could be extenuating factors to consider. Did a tire blow out? Was there something in the road? Was the driver unlawfully over-served by an alcohol provider? Did poor road design contribute to the crash? Likely or not, it’s important there are experienced investigators handling things so nothing unusual slips through the cracks.

For example, it stands out that only one person had any reported injuries here—serious ones, apparently. While there could be a reasonable explanation for this, it’s the sort of outcome one might see if a vehicle had defect safety devices. Did that victim’s seatbelt or airbag fail? Were they seriously injured because something which helped protect the other occupants in the vehicle failed to protect the victim? This can require extensive training and specialized tools to look into, which might not be resources officers here had access to.

Ultimately, it could be that authorities were able to have experienced, well-equipped officers look into things and rule out extenuating possible factors like a defect. However, I’ve had countless cases where victims and families asked officers about these possibilities, and authorities have no answers for them. That’s when it may be time for more thorough independent investigators to pick up the slack.
