Commentary by Attorney Michael Grossman

I’ve seen many multi-vehicle accident investigations over my long career, and they’re not all created equal. There are probably dozens of things that should be looked into after a crash, but there are three questions authorities should be able to answer after any crash investigation. What are those 3 questions?

1. Did the authorities thoroughly investigate the crash?

It’s vital that in accidents such as this, that the investigation is as thorough as possible, as missing even one detail can affect the investigation. What kind of details? They could include:

  • Whether law enforcement conducted a detailed accident reconstruction, including analyzing vehicle positions and damage.
  • If all drivers and witnesses provided statements about what they observed.
  • Whether environmental factors, such as weather, road conditions, or visibility, were examined for their potential roles in the crash.

You might think that these are fairly basic investigative practices that should be done after any crash. Unfortunately, there are many crashes where something is missed by the on-scene investigators.

2. Has anyone looked into the possibility that a vehicle defect caused the crash?

In a multi-vehicle collision like this, the possibility of a mechanical failure in one or more vehicles must be considered and investigated, paying attention to very detail. Key areas of focus can include:

  • Brake or steering malfunctions that could have initiated the chain of events.
  • Advanced safety features, such as collision avoidance systems, that may have failed to operate correctly.
  • Whether any of the vehicles involved had known recalls or outstanding maintenance issues.

This one is usually missed. In my experience, due to a lack of training and resources, it’s very rare for authorities to be able to identify vehicle defects.

3. Has all the electronic data relating to the crash been collected?

Electronic control modules (ECM’s) also called “black boxes” are equipped on modern vehicles and can provide valuable insights into how the vehicle was operating prior to and during the crash. Such pieces of information are:

  • Braking, acceleration, and steering data.
  • If airbags and other safety measures deployed as intended.
  • Fault codes that could indicate a mechanical failure.

Cell phone data is also very important, as it can show whether a driver was potentially distracted in the moments leading up to an accident. Collecting all this data is essential because it is often the best source of what was happening in the minutes leading up to a crash.

As a general rule of thumb, if authorities can answer these questions to the satisfaction of those affected by the crash, then it was a good investigation. When they cannot, then it might be necessary to bring in an independent investigator to get to the truth.
