Commentary by Attorney Michael Grossman
Rear-end collisions involving motorcycles are among the most dangerous types of crashes, and when they involve a chain reaction, the need for a thorough review becomes even more important. A fatal outcome demands more than a basic report—it requires a full understanding of what went wrong and why.
1. Did the authorities thoroughly investigate the crash?
Crashes involving multiple vehicles and a motorcycle should be reconstructed with precision. Investigators need to determine each vehicle’s position, the spacing between them, and how much time passed between the initial braking and the impact. Rear-end crashes often get labeled as simple driver inattention, but without proper scene mapping and analysis, other factors can go unnoticed—especially when the motorcyclist isn’t able to speak for themselves.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
If the Honda that struck the motorcycle experienced brake failure, unresponsive driver-assist systems, or a delayed sensor alert, that could explain the driver’s failure to stop in time. These kinds of failures can happen suddenly and may leave no obvious signs. Without a mechanical inspection of the Honda—especially its braking and collision-avoidance systems—those possibilities remain open.
3. Has all the electronic data relating to the crash been collected?
Data from the Honda could confirm how fast it was traveling, when the brakes were applied, and whether any forward-collision warnings were triggered. This information can clarify whether the crash was purely human error or if the car failed to assist the driver as it should have. If any of the vehicles were equipped with dash cams or other recording devices, that footage would be equally critical to understanding the sequence of impacts.
The reality is that motorcycle crashes often come with severe consequences, and assumptions can’t be allowed to fill in the blanks. A complete investigation is the only way to ensure the full truth is on record.
Plain-language takeaways:
- Multi-vehicle crashes involving motorcycles must be reconstructed with care and detail.
- The striking vehicle should be inspected for possible braking or sensor malfunctions.
- Electronic data can help confirm how the crash unfolded and whether the driver reacted in time.
