Commentary by Attorney Michael Grossman

Any allegation of alcohol is going to raise red flags, but those flags are more glaring when authorities allege a kid was under the influence of alcohol. If the allegations prove true, that brings up a very important question: Where did the alcohol from?

Laws surrounding providing alcohol to minors can be more complex than people may realize. It might not be as simple as charging that individual or punishing a negligent establishment. In Texas, someone who provides alcohol to a minor can actually be responsible if that alcohol contributes to an accident like the one described here. That’s why there needs to be effort beyond just investigating the crash itself. More likely, there were events long before the driver got behind the wheel that led to this happening. That, too, needs to be addressed appropriately, and Texas law provides avenues for doing so.
