Commentary by Attorney Michael Grossman
When I hear about a crash like this, my first thought is that I hope the injured driver receives the medical care they need and that investigators can determine exactly what happened. A vehicle becoming entrapped and catching fire raises serious questions, and while it may be tempting to assume the cause was driver error, experience has taught me that crashes like this often require deeper scrutiny. To fully understand what led to this incident, three key questions must be asked.
The first question is whether authorities are conducting a thorough investigation. Law enforcement officers do their best with the resources available, but their ability to analyze crash scenes varies from department to department. Given that the vehicle caught fire after the crash, investigators should be considering all possible contributing factors. Were road conditions a factor? Were there any obstacles or external influences that forced the driver to react suddenly? Most importantly, what caused the fire? Fires following a crash are uncommon in modern vehicles unless there is a fuel system failure, an electrical issue, or another mechanical problem. A complete investigation should address these concerns.
The second question is whether anyone has considered the possibility of a vehicle defect. While many assume that single-vehicle crashes result from driver mistakes, mechanical failures—such as brake malfunctions, steering issues, or electrical problems—can also cause a vehicle to lose control. The fact that the vehicle caught fire adds another layer of concern. If there was a defect in the fuel system, electrical wiring, or another critical component, that could explain why the fire started and spread so quickly. Unfortunately, vehicle defects are rarely investigated unless someone actively pushes for it, and if the vehicle is quickly scrapped, crucial evidence could be lost.
The third question is whether all electronic data related to the crash has been collected. Modern vehicles are equipped with electronic control modules (ECMs) that store key data, including speed, braking, and steering input in the moments before a crash. This data can provide critical insight into what happened leading up to the accident. Additionally, if there were any nearby surveillance cameras or traffic cameras, they might have captured footage that could help clarify the circumstances of the crash. Without this information, key details may remain unknown.
At the end of the day, ensuring a thorough investigation isn’t just about determining liability—it’s about making sure the affected driver and their loved ones understand exactly what happened. Fires after a crash are not typical, and if there was a defect that contributed to the severity of this accident, identifying it could prevent future incidents. We owe it to those involved to ensure that no potential factor is overlooked.
