While details aren’t confirmed, authorities reported looking into the possibilities of alcohol. Frankly, at 11:40 p.m. with four people in their 20s, it would be irresponsible not to investigate the possibility of alcohol. But that’s not just to find a way to blame a driver, though drunk driving would warrant appropriate consequences. Something people too often overlook is that a lot of alcohol providers are eager to take advantage of younger customers by unlawfully over-serving them. Those alcohol providers can also face serious consequences.
Simply put, it’s illegal in Texas for bars, restaurants, stores, and other alcohol providers to serve someone who is obviously intoxicated. Doing so can expose those establishments to potential criminal investigations, fines, suspended licenses, and liability for the injuries resulting from that intoxication. Too often, though, these potential consequences are brushed aside. Authorities don’t often consider any details beyond the crash scene. That’s why across the hundreds of alcohol-related accident cases I’ve handled, few involved any kind of criminal investigations into the complicit alcohol providers until we brought them to light through our own investigations.
So while I can’t say what happened here, experience makes me skeptical that answers from the authorities will get the whole story. It’s one of the reasons I do what I can to inform folks about possible alternative legal avenues to getting the resolution they deserve. Victims and families deserve to know they have an opportunity to make things right after a serious accident, and sitting around waiting on police isn’t always the way to see that happens.
